Privacy Policy

This Privacy Statement discloses the privacy practices of Hawai‘i Data Collaborative (“HDC”), for all websites, text-based surveys, web-based surveys, mobile device platforms, applications, or other interactive services that include an authorized link to this Privacy Statement (all such websites, text-based surveys, web-based surveys, mobile device platforms, applications, or other interactive services are referred to collectively as the “Platform”).

In this Privacy Statement “we” and “us” refer to HDC, and “you” and “your” refer to users of the Platform. Capitalized terms that are not defined in this Privacy Statement shall have the same meaning as is assigned to them in the Terms of Use (the “Terms”).

PLEASE READ THIS PRIVACY STATEMENT CAREFULLY.  BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND TO ALL THE TERMS OF THIS PRIVACY STATEMENT AND OUR TERMS OF USE. IF YOU DO NOT AGREE TO THIS PRIVACY STATEMENT OR OUR TERMS OF USE, DO NOT ACCESS OR USE THE SERVICES IN ANY MANNER.

Because HDC is committed to your privacy, we provide this information on our information practices:

  • What personally identifiable information about you is collected through the Platform;

  • How the information is used;

  • With whom the information may be shared;

  • What choices are available to you regarding our collection, use and distribution of the information;

  • The kind of security procedures that are in place to protect the loss, misuse or alteration of information under our control; and

  • How you can correct any inaccuracies in the information.

HDC only does business with, and the Platform is only intended for use by, persons in, and residents of, the State of Hawaii. The Platform is not intended for use by persons in, or residents of, the European Union or California. HDC does not have an establishment in the European Union or California, nor does HDC offer or provide any goods or services to (or otherwise do business with) persons in (or residents of) the European Union or California, and HDC does not monitor the behavior of persons as far as their behavior takes place in the European Union or California.  Accordingly, HDC and the Platform are not subject to the General Data Protection Regulation (GDPR) or the California Consumer Privacy Act of 2018 (CCPA). If you are currently in (or a resident of) the European Union or California, you agree that you will not provide any information to HDC in any manner, including through the Platform. 

Information Collection and Use
We collect information from our users at a variety of locations on our Platform. HDC may share the Data collected on the Platform with its service providers and partners, community organizations, and affiliates (together, the “HDC Parties”).  The types of data collected, used, and shared by the HDC Parties include, but are not limited to, mobile numbers and personal information associated with Participant’s characteristics such as (but not limited to) age, gender, zip code, employment status, household income, household size, participation in welfare programs, housing tenure, and level of education (together, the “Data”).   HDC may collect or store personal identifying information (PII) as part of the aforementioned Data collected.  We are the sole owner of the Data and will not sell, share or rent this information to others, except with the HDC Parties, or as otherwise disclosed in this Privacy Statement.

Keyword Consent
In order to use certain areas of the Platform, you first must consent to the Terms.  This may require you to text a secret keyword using your mobile device to the phone number designated by HDC.  You may be required to give contact information and other personal information (e.g., your mobile phone number). We use this information to contact you about the services available on the Platform.

Text Messaging and Other Communications
We may communicate with you through text messaging, describe our services, or to contact you regarding your transactions or inquiries on the Platform. We collect relevant contact information regarding your mobile phone number for these purposes.

Cookies
A cookie is a piece of data stored on the user’s hard drive containing information about the user. Cookies may include information such as the user or session ID, or other information that identifies a user. Cookies allow us to confirm that you are a valid user as you navigate through the Platform. Once you close your browser, or once you are logged off the Platform, the cookie simply terminates. You can configure your browser not to accept cookies. If you reject the cookie, you can still use the Platform, although your use will be limited.

Log Files
Your computer reaches us via an Internet Protocol or “IP” address. We may use IP addresses to analyze trends, administer the Platform and gather broad demographic information for aggregate use.

Information Sharing
We may provide or sell aggregated demographic information to other organizations. Aggregated information means information that is a collection of data about many users, and from which no data specific to any one user can be obtained. We also work with other companies, such as those which host our Platform, and those companies may therefore have access to some data on our servers. That access is subject to confidentiality protections that we place in our agreements with those companies, and they cannot use the data for any purposes other than those stated in the contract.

This Privacy Statement applies solely to information collected by the Platform. The Platform may contain links to other sites. Please be aware that we are not responsible for and do not know the privacy practices of such other sites. We encourage our users to be aware when they leave our Platform and to read the privacy statements of each and every website that may collect user information.

Security

We take precautions to protect your information. When you submit sensitive information via the survey, website, your information is protected both online and offline.

Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way.   

Data collected is stored in a secure, cloud-based database equipped with Transport Layer Security (TSL) and Secure Socket Layer (SSL) technology that safeguards data by using both server authentication and data encryption, hosted in a secure server environment that uses a firewall in combination with other protocols to prevent interference, access from outside intruders, and other types of data breaches.

Only HDC Parties are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Surveys
From time to time, our Platform may request information from users via surveys. Participation in these surveys is completely voluntary and the user therefore has a choice whether or not to disclose responsive information.

Minors
The Platform is not intended for anyone under the age of 18. We do not intend and do not wish to collect any information from, or about, any person who is under the age of 18 years. If you are under 18, you should not provide any information to us in any manner.

Disclosure for Law Enforcement Purposes
In addition to the circumstances described above, we may disclose your information if required to do so by law, court order, subpoena, or as requested by other government or law enforcement authority, or in our good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect your rights and others with whom we do business, or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties; or when anyone else could be harmed by such activities. Unless otherwise required by law or if notice would pose a danger to you or another party, we will notify you in writing prior to the release of any of your information.

Review and Correction of Information
If a user desires to change personally identifiable information, or no longer wishes to use our service, we will endeavor to provide a way to correct, update or remove that user’s personal data provided to us. This process can be initiated by e-mailing info@ohanapulse.org.

Modification
We may change or modify our privacy policies from time to time. Any such changes or modifications will be effective immediately once they are posted on the Platform. This Privacy Statement was last updated on July 9, 2021. We recommend that you periodically review this page. We do this so our users are always able to be aware of what information we collect, how we use it, and under what circumstances we disclose it. We will use information in accordance with the Privacy Statement under which the information was collected.
